How Do I Get Debt Collectors To Stop Calling?

If you’re behind in your payments, call from a creditor may be an on-going frustrating occurrence. You may be asking yourself  “How do I get debt collectors to stop calling me?” One thing you should know is that there are laws about how and when they can contact you. For example, creditors can not call before 8 a.m., after 9 p.m., or while you’re at work if you tell them not to. Debt collectors may also not harass you or lie when trying to collect. Most importantly, if you ask them in writing to stop calling, they must do so.

To stop collection calls, ask for the debt collector’s mailing address and tell them – in writing – to stop contacting you. Make sure to keep a copy for your records. Send your letter by certified mail, and pay for a “return receipt” to document when the collector received it. Once they receive your request, they’re not allowed to contact you again. However, there are two exceptions:

  • A collector can contact you to confirm that will be no further contact, and
  • They can contact you to notify you that they are taking a specific action, like filing a lawsuit.

Keep in mind, your debt still exists and you’re still responsible for it. Your formal request is just to stop the collection calls. Hiring a local bankruptcy attorney may be the best option if you are looking more help. After all, the debt collector can often still sue you to recover the debt. It is best to get ahead of any lawsuits filed.
