Do I have to go to Court if I file for bankruptcy?

A prospective client usually wants to know if they will be  required to attend bankruptcy  court if they file for bankruptcy. My answer is that percentage wise, only a small number of Debtors attend bankruptcy court for various reasons. The percent is a little higher in chapter 13 cases where debtors can be in a case for as long as five years . Debtors are required though to attend “creditors meeting” which usually involves just a trustee asking a few questions. Creditors are allowed to attend and ask questions but in most cases , they do not.

Even if you are required to attend bankruptcy court at some point during your case, many hearings are routine and only require your attendance .
